An inconvenient truth --Abuse of government power by tax authority

In 2007, the highest court has brought a verdict of not guilty on Tai Ji Men unjust criminal case. In addition, in January of 2010, all of the defendants have received compensation from government for injustice. However, today, over 10,000 Tai Ji Men dizi are forced to leave the academy where they practice qigong. The judicial system in Taiwan is only a joke?

Tai Ji Men is tax-exempt because it is neither a cram school nor a profit organization. There has never been any tax issue concerning Tai Ji Men since its inception in 1966. The Tai Ji Men tax case of injustice is derived from the unlawful and untrue accusation filed by prosecutor Ho who made up income of over NT$ 3.2 billion out of bank accounts with balances of only NT$ 610,000 and plus. In the bill of indictment, prosecutor Ho claimed it is a fraud should be confiscated, while on the other hand, he said it is a tuition income and should be taxed. The bill of indictment is self-contradictory and a classic example of double jeopardy. After 10 years and 7 months in 3 court trials, Tai Ji Men was ruled not guilty, no fraud, no tax evasion and no violation of tax codes.

Tai Ji Men dizi has to abide by the ancient ceremony to express his gratitude and respect for shifu and submit a red envelop to Zhang-men-ren. The court also recognized that the red envelop from dizi to shifu is voluntary giving in nature and should therefore be tax-exempt as per Article 4.17 of tax codes. The aggregate ordering of uniforms and meditation mat for other Tai Ji Men dizi is an act out of brotherhood, not profit-seeking, and Zhang-men-ren has never been involved in the ordering. The not for profit nature was also confirmed by the highest court. The four defendants in the criminal case have eventually all received compensation from the state for unjust accusations.

The tax administration does not follow the updated judicial verdict and, nevertheless, it applies an abandoned verdict to conceal the public and issued illegal tax payment notice to Tai Ji Men for 14 years. The tax issues concerning Tai Ji Men are purely groundless. The tax bills are based upon the ineffective evidences which have been overruled by courts. The charges against Tai Ji Men and tax bills issued by tax administration and Ministry of Finance are false, illegitimate and unlawful. The tax authority has gone too far and intended to auction off the branch academy of Tai Ji Men. Tai Ji Men dizi are forced to leave the academy where they practice qigong and cultivate hearts. It has been long 14 years that Tai Ji Men dizi endure state violence. With deep love for Taiwan and its people, Tai Ji Men dizi have decided to stand up against the abuse of government power and make public the facts of persecution of state violence. It is hoped the state governance be improved, structural problems solved, and civil rights of people protected so that prosperity will prevail.

President Ma, Ying-Jeou of Republic of China, Taiwan had signed “International Covenants on Civil and Political Rights” and “International Covenant on Economic, Social and Cultural Rights” on Dec. 10, 2009 to follow the international standard of human rights. However, his administration has seriously abused government power and violated human rights provisions as set out forth in the two Covenants and the Universal Declaration of Human Rights, G.A. res. 217 A (III) in Paris on December 10, 1948.

Tai Ji Men Qigong Academy, established in 1966, is a non-profit, non-religious, non-political culture group that preserves the essence of high Chinese culture and promotes love and peace around the world. The Taiwanese tax authority assessed unfair and inequitable taxes on Tai Ji Men and violated many tax codes. Many internal human rights organization in United States, France and Russia are calling on the Taiwan government to terminate unjust taxation to ensure the transparency of administration. They also indicate the “Destroyer of culture is the sinner of history.” to remind the officials to of Taiwan government to protect human rights and culture heritage.
