There are four branches to the US government. The first is the sum of the rest, We the People are the reason for our government, our freedoms and our liberties, we are the entity upon which our Constitution was designed to protect. The legislative process serves our interest, the Supreme court defines our meaning and the executive office serves the public trust. As Mike Marchildon del-norte k-12, my sons social studies teacher has pointed out in an e-mail reply, judicial review has a place in overruling ballot legislature, but as we fail to see one side or the other of Congress apply that option, the will of the people must compel Congress to act responsibly in representing Americans.
When We the People vote a measure on the ballot, no other entity of our governing system can repeal or overrule our will, with the exception of judicial review, the only option for over turning a majority vote of the people is to return the legislation to ballot for the people to reconsider. If the measure is repealed without the consent of the people, then our Constitutional rights have been violated. It is human nature to make mistakes, but when the people vote, then we must live with the result until the measure is placed back on the ballot. Just as we must live with taxes and declarations of war, we must endure the will of We the People.
In the case of Prop. 8 in Ca. a double standard is being applied between a state law and the acts of the US Congress. We either have a voice in every government entity, or we have no rights an no voice.
